What is an Uncontested or “Agreed” Divorce?
In many situations, especially when parties have been married a short time, there are no children of the marriage and there are few marital assets to be divided. Parties in this type of situation and who are agreeable can obtain a divorce quickly (within 60 days). In these cases, one party can hire an attorney to draft a Decree of Divorce that reflects the parties’ agreement. If the proposed Decree meets the parties’ approval, the attorney can then present the Final Decree of Divorce to the Court for approval. With short testimony, from either party, under oath, the divorce can be finalized.
